These Terms and Conditions (“Terms”) are an agreement between you and [[PLACEHOLDER: legal entity / company name]] (“we,” “us”) governing your use of the MagicKeyPen application (“the app”). Please read them.

1. Acceptance of these Terms

By downloading, installing, or using MagicKeyPen, you agree to these Terms. If you do not agree, do not install or use the app.

2. License to use the app

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use MagicKeyPen on Mac computers you own or control, for your own purposes.

You may not: reverse engineer, decompile, or disassemble the app except to the extent that restriction is prohibited by law; rent, lease, sell, sublicense, or redistribute the app; or remove or alter any proprietary notices.

3. Acceptable use and your responsibilities

You are responsible for how you use MagicKeyPen. In particular:

Recording laws and consent are your responsibility. MagicKeyPen records your screen and captures keystrokes on your Mac. Laws in many places restrict recording screens, capturing keystrokes, and recording or monitoring other people. You are solely responsible for complying with all laws that apply to you, and for obtaining any consent required before you record, monitor, or capture anyone else’s screen, input, communications, or activity. This includes recording sessions that involve other people, shared screens, or another person’s device or input. Do not use MagicKeyPen to capture anyone’s input or screen without the consent the law requires.

Lawful use only. Do not use MagicKeyPen for any unlawful purpose, or to capture, store, or share content you do not have the right to capture, store, or share.

Your own content and security. You are responsible for what you choose to record and for keeping your recordings secure. If you are about to enter something sensitive, remember you can pause keystroke capture. We are not responsible for sensitive information you choose to record.

4. Intellectual property

The app. MagicKeyPen — including its software, design, and name — is owned by us (or our licensors) and is protected by intellectual property laws. These Terms grant you a license to use the app, not any ownership of it.

Your recordings. MagicKeyPen creates your recordings and event logs on your Mac. You own your recordings and the content in them. We claim no ownership of, and acquire no rights in, anything you record. Because your content never leaves your device through the app, we do not access it.

5. Disclaimer of warranties

MagicKeyPen is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

We do not warrant that the app will be uninterrupted, error-free, or free of defects, or that it will capture, save, or preserve any particular recording. You are responsible for keeping your own copies of anything you value.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

6. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, recordings, profits, or goodwill, arising out of or relating to your use of (or inability to use) MagicKeyPen — even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for any claim relating to the app will not exceed [[PLACEHOLDER: liability cap — e.g., the amount you paid for the app, or a fixed nominal amount such as US$50 for a free app]].

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

7. Termination

This license and these Terms apply until terminated. Your rights under these Terms end automatically if you breach them. You may end them at any time by ceasing to use MagicKeyPen and deleting it. On termination, the license in Section 2 ends, but sections that by their nature should survive (including Sections 4–6 and 9) continue to apply. Deleting the app does not delete recordings you have already saved; those remain your files to manage.

8. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Effective date” above and make the updated Terms available with the app or through its distribution channel. Your continued use of MagicKeyPen after an update means you accept the revised Terms.

9. Governing law
